2.- DATA COLLECTION: What kind of data do we collect and how do we obtain them?

The personal data that HOSTAL CUBA processes consists of personal data collected through the forms provided on the website and also during the check-in in order to register either customers or third parties.

The data collected by HOSTAL CUBA are the following: first name and surname, date and place of birth, nationality and identity document, e-mail address, home address, payment medium data and signature. Other data may also be obtained if provided by the customer  explicitly for the purpose of fulfilling special requests.

HOSTAL CUBA may also collect customer data through third parties when customers give their express consent on the various social media or when they have so stated through travel agencies, OTAs or tour operators that sell overnight stays at the HOSTAL CUBA.

In connection with the data collected as stated in the previous paragraph, HOSTAL CUBA will only collect the name and the email address in the first case, whereas in the second case the data collected will be any that which is essential for the provision of services that have been requested.

Unless expressly provided to the contrary, all the information requested in the forms must be completed, and, in particular the data subject’s explicit consent clause. In case of failure to provide any of the data that is marked as mandatory, HOSTAL CUBA, depending on the circumstances, may decide not to proceed with the concerned request.

HOSTAL CUBA will also be able to collect images from security cameras installed in the reception and common areas. HOSTAL CUBA will inform Users of the existence of such cameras by displaying information signs and advising them that images are recorded in the premises, as well as concerning the possibility to exercise the corresponding rights.

3.- PURPOSE AND LEGAL GROUNDS FOR DATA PROCESSING: What do we use your data for?

HOSTAL CUBA informs data subjects that their personal data will be used by the company PLANELLA FERRER, SL, for the following PURPOSES:

i. Processing of Users’ requests

HOSTAL CUBA will only process the data insofar as it is necessary in order to fulfil User´s information requests or to provide the contracted services. Therefore, we will process data such as your first name, surname(s), home address, e-mail address, telephone number and, if applicable, credit card details. Data processing will only take place if HOSTAL CUBA has obtained the User’s explicit consent and provided that the processing is necessary for the performance of the contract to which the data subject is a party or for the implementation of pre-contractual measures at the User’s request.

HOSTAL CUBA will also process the Users’ information that is required in order to handle any incidents that may be reported to or detected by HOSTAL CUBA. This data processing will only be carried out in order to properly address such incidents or to solve any problems arising from them.  Such processing is essential in order to satisfy the legitimate interests of HOSTAL CUBA and to meet the Customer’s needs.

ii. Sending of reminders in case of non-completion of bookings. HOSTAL CUBA may, with the User’s express consent, may send them reminders about the non-completion of a booking initiated by the data subject, on the basis of the information that the User may have provided through the website.

HOSTAL CUBA shall be entitled to carry out such processing only with the explicit consent of the data subject.

iii. Analysis of customer interactions with our website.  HOSTAL CUBA may process the personal data of website Users, employing for that purpose their IP or MAC address in order to analyse interactions, movements, scrolls, visits or product inquiries that the User may have made on our website.

This processing is essential in order to satisfy the legitimate interests of HOSTAL CUBA.

iv. Website computerised control, system incident reporting and management of the same. HOSTAL CUBA will perform any surveillance and control actions regarding website use that are necessary in order to prevent and detect any fraudulent use, non-authorised access, alterations or loss of personal or non personal information.

HOSTAL CUBA is entitled to carry out this processing for the purpose of complying with the legal requirements set forth in the Spanish Law on the Information Society and Electronic Commerce, as well as to satisfy the legitimate interests of HOSTAL CUBA in guaranteeing network and data security.

v. Handling of requests concerning data protection rights and incident reporting. Based on the forms provided by HOSTAL CUBA, HOSTAL CUBA will process personal data in order to fulfil our customers’ requests.

vi. Processing of images obtained through security cameras. HOSTAL CUBA has installed security cameras with the aim of guaranteeing our customers’ security within the premises, as well as to control access to the hotel.   

This processing is essential in order to satisfy the legitimate interests of HOSTAL CUBA.

vii.- Job application management -  In case that personal data is provided through the “WORK WITH US” section, HOSTEL CUBA will collect the first name and surname, e-mail address, telephone number, position for which the candidate is applying and the data contained in the curriculum vitae provided by the same candidate. This data will be solely collected for the purpose of processing candidates´ applications for any possible job offers.

HOSTAL CUBA is entitled to carry out this processing by virtue of the User’s express acceptance.


The personal data to which HOSTAL CUBA is given access will be processed for as long as it is necessary to do so in order to fulfil the purpose for which such data was collected. The data pertaining to the customer´s credit card will be deleted once the checkout has been successfully completed and all outstanding amounts have been settled.

Notwithstanding the foregoing, HOSTAL CUBA will continue to store such personal data, duly blocked, after they are no longer relevant for the purposes for which such data was collected for the purpose of making it available to the competent Public Administrations, Judges and Courts or the Public Prosecutor´s Office until such time as any actions that may arise from relationship with the customer become time-barred and/or the statutory data retention period expires. After the expiration of these deadlines, the data will be deleted.

The images recorded by the security cameras installed at the premises will be stored for a maximum period of one month from their recording and will be deleted after the expiration of the aforesaid period.


HOSTAL CUBA may transfer your personal data to:

· Third party contractors, upon the User´s express request.

· Competent public authorities, law enforcement agencies, judges and courts, upon their request.

In addition to the above-mentioned data transfers, HOSTAL CUBA cooperates with third party service providers who have access to customers’ personal data and who process such data in the name and on behalf of HOSTAL CUBA in connection with the provision of their services.


Data subjects may exercise their rights to access, rectification and erasure; they may also request the restriction of processing of their personal data, object to such processing, request the portability of their data, as well as exercise their right not to be the subject to a decision based solely on automated means, as follows:

Any data subject, who, by any means whatsoever, becomes aware of a possible security breach or incident that has led to unauthorised access, alterations, modifications or erasures of personal data concerning the data subject or belonging to any third parties, may report this incident at the following e-mail address:

Data subjects may file a complaint with the Spanish Data Protection Agency if they do not find HOSTAL CUBA’s reply satisfactory in connection with the exercise of their rights.
